Terms and Conditions

EFFECTIVE JANUARY 1, 2019.

By accessing this website, booking services, or purchasing products from BusyB Writing, LLC, you agree to be bound by these Terms and Conditions. BusyB Writing, LLC reserves the right to update or modify these Terms at any time. Continued use of services or the website constitutes acceptance of any updated Terms. These Terms shall be governed by the laws of the State of Georgia; however, any services performed within Florida may also be subject to applicable Florida laws.

BOOKING AGREEMENT FOR APPOINTMENTS MADE THROUGH CLIENT PORTAL

All calls on the conference line will be recorded for quality assurance and record-keeping. All [potential] clients have the right to receive a copy of the call as well, for your records, upon request.

We want you to be comfortable trusting BusyB Writing with your project. Therefore, it is encouraged to book a free clarity call to get a feel for what we can do for you. Please note that all free calls are for answering questions concerning services ONLY. If you’re looking for specific advice on marketing, publishing, or writing, we have consultations available for a small fee in the service menu.

Lastly, BusyB Writing reserves the right to make periodic updates to its offerings and services to better assist clients. Within two (2) business days of your call, you will be provided a total price for your services. The price quoted to you will be honored for 30 days. After 30 days, pricing will be subject to current services and offerings.

LATE FEES FOR SERVICES

If a client elects to do business with BusyB Writing, he or she will be obligated to make payments for any services rendered. Failure to pay invoice(s) by 11:59 p.m. EST seven (7) calendar days after the invoice due date will result in a twenty-five dollar [$25] fee per additional seven [7] days of non-payment. Legal action will be taken after sixty [60] days of non-payment, and Client will be responsible for both outstanding balance and all legal fees, including reasonable attorney’s fees, court costs, and collection expenses. Furthermore, all services will be suspended until payment has been received.

TRAVEL FEES FOR SERVICES

If the client elects to do business face-to-face for any service, a minimum $25 fee will be added to each invoice for each individual session for all travel within a 50-mile radius of Orlando, Florida. Any travel outside of this region will incur an additional fee based on the distance from Orlando, Florida. Sorry, we do not go to private residences. In-person services must take place in an office, bookstore, or other public location. Please contact info@busybwriting.com for a quote on the fee to travel to you.

DEPOSIT REQUIREMENTS FOR BOOK PUBLISHING SERVICES

Client must pay a deposit (not to exceed 30% of total project cost) prior to any work being performed by BusyB Writing, LLC . This deposit is 100% refundable in the event that BusyB Writing, LLC is unable to complete the services outlined in the Scope of Project section of contract; however, there are no refunds for completed work. Deposit amount will be deducted from total cost of services.

LIMITATIONS OF LIABILITY

BusyB Writing, LLC cannot guarantee that work will be completely error-free. Therefore, BusyB Writing, LLC cannot be liable to Client or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if Client has advised BusyB Writing, LLC of them. The price at the beginning of this contract is based on the time investment BusyB Writing estimates is needed to accomplish everything that the Client wants to achieve with services. If Client wishes to change the arrangement or add additional services, a separate estimate will be provided.

Revisions must be requested within seven (7) business days of delivery and are limited to adjustments within the original agreed-upon scope of work. Please note that there will be a minimum of 1 week (7-day) extension to the due date per revision. Furthermore, if Client sends requested documents after the date outlined by BusyB Writing in the email communication, there will be a minimum ten [10] day extension to the project’s due date. Client is allotted 2 revisions after final document is sent. After two revisions, it will be $75 per additional revision.

When working with BusyB Writing, LLC, Client represents that all materials provided to BusyB Writing are owned by Client or used with proper authorization. Client agrees to indemnify, defend, and hold harmless BusyB Writing, LLC from any claims, liabilities, damages, or legal actions arising from materials supplied by Client.

If any provision of the contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the contract and shall not affect the validity and enforceability of any remaining provisions.

CONFIDENTIALITY

BusyB Writing may have had access to proprietary, private and/or otherwise confidential information (“Confidential Information”) of the Client. BusyB Writing will not at any time or in any manner, either directly or indirectly, use for the personal benefit of the BusyB Writing or divulge, disclose, or communicate in any manner any Confidential Information. BusyB Writing will protect such information and treat the Confidential Information as strictly confidential. This provision shall continue to be effective after the termination of the Agreement.

COPYRIGHT

All materials, content, manuscripts, drafts, or intellectual property provided by the Client prior to the start of services shall remain the sole property and copyright of the Client. BusyB Writing, LLC claims no ownership rights over Client-submitted materials.

All work product, drafts, formatting, designs, written materials, or deliverables created by BusyB Writing, LLC remain the exclusive property of BusyB Writing, LLC until full payment has been received. BusyB Writing, LLC reserves the right to withhold delivery, publication files, editable files, or final versions of any work until the invoice has been paid in full. No license, ownership rights, or permission to use the work is granted until payment is completed. Client agrees not to use, publish, reproduce, distribute, or otherwise exploit any drafts, concepts, or materials created by BusyB Writing prior to full payment.

Upon receipt of full and final payment, copyright ownership of the completed deliverables created under the agreed scope of work shall immediately transfer to the Client, unless otherwise specified in writing.

BusyB Writing, LLC retains the right to reference or display non-confidential excerpts or samples of completed work for portfolio, marketing, or promotional purposes only with the Client’s prior written consent.

DEPOSIT REQUIREMENTS FOR SERVICES (EXCLUDES BOOK PUBLISHING)

Client must pay a $250 deposit prior to any work being performed by BusyB Writing, LLC. This deposit is 100% refundable in the event that BusyB Writing, LLC is unable to complete the services outlined in the Scope of Project section of the contract or work order. The deposit amount will be deducted from the total cost of services. Projects under $250 must be paid in full before services are rendered.

REFUND POLICY FOR SERVICES

There are no refunds for completed work.

REFUND POLICY FOR MERCHANDISE

All sales are final. There are no refunds or exchanges for any merchandise.

DISCLAIMER FOR DIGITAL PRODUCTS, COURSES, WRITING INTENSIVES, COACHING SESSIONS

The information contained in the BusyB Writing courses and on the BusyB Writing website has been derived from sources believed to be reliable and is correct to the best of our knowledge and capacity.

BusyB Writing accepts no liability (including liability for negligence) for any loss or damage (including consequential or indirect loss or damage) that may arise in any way from access to, use of, or inability to use this resource or any material contained in it.

As a student, you are advised to verify all relevant representations, statements, and information.

The entire risk arising out of the use of the materials presented in the BusyB Writing courses and on the BusyB Writing website are distributed as an information source only remains with you.

Any information provided is for the purpose of general guidance.

BusyB Writing makes no guarantees that you will obtain a particular outcome.

Finally, these courses are NOT designed for people who want to create and sell courses.

The course material is copyrighted and can not be reproduced without express written permission.

Any direct or indirect plagiarism of any BusyB Writing material will result in swift legal action.

Once a digital product is available, you will receive a download link to your email within 48 hours. With preorders, you will receive access no later than 1 p.m. EST on the day that the product is set to launch. If you do not receive your email, you may contact questions@busybwriting.com for assistance. Once your link is received and you access the content, the content is yours for life. There are absolutely no refunds for any courses, digital products, coaching sessions, or writing intensives or any deposits towards any of these products for any reason, and any fraudulent attempts to access information or get a refund (e.g., charge-backs) will result in legal action. All legal fees will be the responsibility of the user.

Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between the parties.
